Argos UK, the high street retailer, lost a key trade mark battle in the context of Google AdSense advertising against a US software provider. The debate centred around the domain name Argos.com. In dismissing Argos Uk’s infringement claim, the Deputy Judge held that they had consented to the ads appearing. In addition it was held that the website itself was not targeted at the average UK consumer. This judgment provides new guidance on the use of online advertising, in particular the implications of deploying the Google AdSense system. Virtuoso Legal acted for the successful defendant, Argos Systems Inc.
In this talk, principal of Virtuoso Legal, Liz Ward and solicitor Matthew Lingard will take you on a whistle stop tour through the key parts of the judgment and will highlight new guidance that the Judge has provided on previously unexplored areas. In particular Liz will be discussing the issues of targeting and consent.
