From EUIPO Torpedoes to the renowned red sole, Victoria will explore the big trade mark cases of 2018 so far and the issues arising from them including: locality of goodwill and the section 11(3) defence, the future for colour and shape marks, reputation for the purposes of Art.9(2)(c), website targeting and jurisdiction, invalidity for imprecise specifications.
Victoria joined 3PB in 2009 after having previously been a tenant at Hogarth Chambers and having worked at media firm Wiggin LLP. She has a strong reputation in the fields of trade marks and passing off and has recently been involved in several notable cases before the IPEC including a passing off action relating to the get-up of the infamous Tala Dry Measuring Cup, a trade mark dispute with acquiescence and estoppel raised as a defence, and a dispute where section 11(3) was relied upon. As well as appearing before the IPEC, Victoria regularly advises clients and represents them in proceedings before the Chancery Division, UKIPO and the EUIPO.
