In recent years we have seen a step up in the scrutiny of IP surrounding fiction. This webinar will ensure that you are confident on advising clients in this area.

We will focus primarily on the case study offered by the recent Only Fools and Horses case.

This case had significant knock on effects for the entertainment industries. We will explore the implications that this has had for the world of IP.

Literary copyright exists in respect of fictional characters, separate from the literary works (e.g. scripts and novels) in which they are created and recorded, and we will delve into what this distinction may mean in practice.

We will also investigate how copyright can and cannot protect compilations of scripts.

Crucially, we will also explore the role played by parody and pastiche and identify defences of fair dealing in this area – these defences are very specific, and your understanding of their scope is key to your clients' success.

Finally, get to grips with the role played by public reaction to the defendant’s offering in passing off cases.
