In this session, we take a look at where the EU, Germany and Sweden currently stand on registering unusual or unconventional forms of trade marks, including position marks, olfactory marks, and multimedia marks.
We will explore how these marks are treated across the different jurisdictions and consider the ways in which we might see the field evolve in the future.
Six years on from the requirement to have a “graphic representation” of an EUTM application changing to requiring only a “clear and precise” representation, we look at where we stand today and what the future holds.
The session will investigate the biggest questions around these marks, including:
- Are they easy to obtain, or do they face additional obstacles before being registered?
- What scope of protection do they grant?
- What possibilities for currently unexplored trade mark forms may still lie ahead.
