Uncover the implications of the recent Supreme Court decision in the Amazon case.
The concept of "targeting" has been reinterpreted in the UK legal landscape.
Explore the evolving legal standards for determining when a business is considered to have "targeted" consumers in the UK and EU, particularly in the context of online sales and marketing.
We will also explore the UK Supreme Court and Court of Appeal decisions when it comes to the implications of actual sales made to UK consumers when those consumers were not ‘targeted’ (i.e. the applicability of the Blomqvist v Rolex SA jurisprudence from the CJEU).
Our speakers will go on to unpack recent UK court decisions that highlight the nuances in the law and how they might affect businesses operating internationally.
You will leave with clarity on what facts might lead to a finding of targeting and trade mark infringement in the UK and EU.
This webinar supports skill set 1: IP prosecution and validity of the Advanced Competency Framework.
Learning outcomes:
- Understand what amounts to “targeting” in the UK and how the UK Courts should approach the assessment.
